This Cancellation and Refund Policy applies to purchases, subscriptions, free trials, cancellations, and refund requests made through Explisera.

This Policy forms part of Explisera's Terms and Conditions.
1. General No-Refund Policy
Except where reimbursement is required by mandatory applicable law, all payments made to Explisera are final and non-refundable once processed.
Explisera does not provide voluntary refunds for:

unused subscription time;
-
partially used billing periods;
-
unused generation credits or allowances;
-
failure to use the Service;
-
cancellation after a payment has already been processed;
-
dissatisfaction based solely on personal or subjective preferences concerning AI-generated content;
-
a change of mind after purchasing a subscription;
-
forgetting to cancel before a clearly disclosed renewal date;
-
no longer needing the Service; or
-
deciding not to continue using Explisera after a paid billing period has started.
Cancelling a subscription stops future renewals but does not normally result in a refund of amounts already charged.
Nothing in this Policy limits any mandatory consumer right that cannot legally be excluded under French or European Union law.
2. Free Trial
Explisera may offer eligible users a free trial before they decide whether to purchase a paid subscription.
The applicable trial duration and conditions will be displayed before the trial begins.
If no payment method is required for the free trial, the trial will simply end unless the user separately chooses to purchase a paid subscription.
If Explisera offers a free trial that automatically converts into a paid subscription, the user will be informed before starting the trial of:
-
the duration of the free trial;
-
the price that will apply after the trial;
-
the billing frequency;
-
whether the subscription renews automatically;
-
when the first payment will be charged; and
-
how to cancel before payment begins.
If you cancel before the end of the free trial and before the paid subscription begins, you will not be charged the paid subscription fee.
The availability of a free trial allows users to evaluate Explisera before purchasing. However, a free trial does not remove any statutory consumer rights that apply under French or European Union law.
3. Subscription Cancellation
You may cancel an Explisera subscription through the cancellation functionality made available through your account or through another cancellation method communicated by Explisera.
Where French law requires an online cancellation mechanism, Explisera will provide an appropriate electronic cancellation method.
Cancellation prevents the subscription from renewing for another billing period.
If cancellation occurs after a paid billing period has started, you will normally continue to have access to the paid Service until the end of that billing period.
No prorated refund is provided for the unused remainder of a billing period, except where mandatory law requires otherwise.
For example, if you purchase a monthly subscription and cancel halfway through the month:
-
the subscription will not renew for the next month;
-
you may continue using paid features until the end of the current paid period; and
-
you will not normally receive a refund for the unused portion of that month.
4. Automatic Renewal
Certain Explisera subscriptions may renew automatically.
Before entering into an automatically renewing subscription, Explisera will display the applicable:
-
subscription price;
-
billing frequency;
-
renewal conditions; and
-
cancellation method.
It is the user's responsibility to cancel before the next renewal where they do not wish to continue the subscription.
A renewal that was properly disclosed and correctly processed is not normally refundable simply because the user forgot to cancel before the renewal date.
This does not apply where a refund is required because of a billing error, unlawful charge, valid statutory withdrawal, or another mandatory legal right.
5. No Refunds for Unused Credits or Generation Capacity
Certain Explisera plans may include:
-
generation credits;
-
video-generation allowances;
-
usage limits;
-
processing capacity; or
-
other subscription-based entitlements.
Unless expressly stated otherwise:
-
unused credits have no cash value;
-
unused credits cannot be exchanged for money;
-
unused credits are not refundable;
-
unused credits do not create a right to a prorated subscription refund; and
-
credits may expire or reset according to the applicable plan conditions.
6. AI-Generated Content and Subjective Dissatisfaction
Explisera uses artificial intelligence to produce scripts, scenes, visuals, audio, videos, and other Generated Content.
AI-generated results may vary and may require user review or editing.
Subjective dissatisfaction with:
-
visual style;
-
narration;
-
wording;
-
scene selection;
-
creative choices;
-
AI interpretation; or
-
another non-defective characteristic of Generated Content
does not, by itself, create a right to a refund.
This provision does not affect statutory rights where the digital service or digital content fails to conform to the contract under applicable French consumer law.
7. Statutory Right of Withdrawal
Consumers in France and certain other European Union or European Economic Area jurisdictions may have a statutory 14-day right of withdrawal for certain distance contracts.
Whether the right applies, how it is exercised, and whether it may be lost depends on the type of digital service or digital content and the circumstances in which performance begins.
Where applicable, the withdrawal period generally begins when the relevant contract is concluded.
To exercise a valid statutory right of withdrawal, you must notify Explisera before the applicable withdrawal period expires.

8. Immediate Performance of Digital Services
Explisera provides digital services that may begin immediately after purchase.
Where applicable law requires your express request or consent for performance to begin during a statutory withdrawal period, Explisera may request that consent during checkout.
Where legally permitted, if you expressly request that the Service begin before the withdrawal period ends and later exercise a valid withdrawal right, you may be required to pay an amount proportionate to the Service already supplied.
For digital content not supplied on a tangible medium, the statutory withdrawal right may be lost where all applicable legal conditions have been satisfied, including where required:

you expressly consented to performance beginning before the end of the withdrawal period;
-
you expressly acknowledged that beginning performance would result in loss of the applicable withdrawal right; and
-
Explisera provided the legally required confirmation.
Explisera will not treat a statutory withdrawal right as waived merely because Explisera is a digital platform or because a free trial was available.
9. Legal Guarantee of Conformity
The No-Refund Policy does not limit the legal guarantee of conformity applicable to digital content and digital services under French consumer law.
Where applicable, if Explisera fails to provide a digital service that conforms to the contract, the consumer may be entitled to remedies provided by law.
Depending on the circumstances, these may include:

bringing the Service into conformity;
-
a proportionate reduction in price; or
-
termination of the contract and reimbursement.
These remedies are separate from Explisera's commercial No-Refund Policy.
Nothing in this Policy excludes a remedy that French or European Union law requires Explisera to provide.
10. Billing Errors
The No-Refund Policy does not apply to confirmed billing errors.
You should contact Explisera if you believe that you were:

charged twice for the same subscription;
-
charged an incorrect amount;
-
charged after a cancellation had already legally taken effect;
-
charged without authorization; or
-
charged because of another payment-processing error.

Where an incorrect charge is confirmed, Explisera will take the appropriate corrective action, including reimbursement where required.
11. Failed or Unavailable Service
If Explisera is temporarily unavailable because of maintenance, rendering delays, third-party provider interruptions, high demand, or another temporary technical issue, this does not automatically create a right to a refund.
However, where Explisera fails to provide a purchased Service in circumstances giving rise to a mandatory remedy under French or European Union consumer law, the consumer retains those statutory rights.
12. Account Suspension or Termination
If a user's account is suspended or terminated because of:

unlawful activity;
-
fraud;
-
abuse;
-
infringement of third-party rights;
-
violation of Explisera's Terms and Conditions; or
-
another serious breach attributable to the user,
amounts already paid will not normally be refunded.
This provision applies only to the extent permitted by applicable law.
13. How Refund Requests Are Handled
Explisera does not operate a general discretionary refund program.
A refund request will normally be accepted only where:
-
reimbursement is required by mandatory applicable law;
-
a valid statutory withdrawal right applies;
-
a billing or payment error is confirmed;
-
the legal guarantee of conformity gives rise to reimbursement;
-
Explisera charged the user after a cancellation should legally have taken effect; or
-
another statutory right requires reimbursement.
Requests based only on change of mind, unused subscription time, unused credits, or subjective dissatisfaction will normally be declined.
14. Refund Method
Where Explisera is legally required to issue a refund, it will normally be made using the same payment method used for the original transaction unless another method is agreed or legally permitted.
Processing times may depend on the payment provider, bank, or payment method involved.
Explisera will comply with any statutory reimbursement deadline applicable to the relevant situation.
15. Chargebacks
If you believe that a charge is incorrect, you should contact Explisera first so that we can investigate the issue.
Fraudulent or abusive chargebacks may result in suspension of the associated account where permitted by law.
Nothing in this section restricts your right to dispute a genuinely unauthorized or incorrect transaction with your bank or payment provider.
16. Changes to This Policy
Explisera may update this Cancellation and Refund Policy to reflect:

changes to our subscription model;
-
changes to billing practices;
-
changes to the Service;
-
legal or regulatory developments; or
-
other legitimate operational requirements.
The current version will display the latest update date.
Where applicable law requires notice of a material change affecting an existing subscription, Explisera will provide such notice.

18. Mandatory Consumer Rights
This Policy is intended to establish Explisera's commercial policy that paid subscriptions and charges are non-refundable once processed.
However, this Policy does not exclude, limit, or replace any mandatory right available to a consumer under French or European Union law.
Where this Policy conflicts with a mandatory legal requirement, the mandatory legal requirement will apply.
